JAMMU, SEPT 21: The Jammu and Kashmir Government has dismissed Grade-II teacher Khalid Hussain from service over his alleged involvement in a case registered under the stringent Protection of Children from Sexual Offences (POCSO) Act, invoking the exceptional provisions of Article 311(2)(b) of the Constitution.
Hussain, posted at Government Middle School, Bumalpora, Gurinalla, Zone Inderwal, Kishtwar, was named in FIR Number 34/2026 registered at Police Station Chatroo.
The FIR invokes Sections 61(2), 65(1), 90, 91 and 92 of the Bharatiya Nyaya Sanhita (BNS), 2023, along with Sections 4, 6, 8, 10 and 17 of the POCSO Act, 2012.
Acting on the material placed before it, the School Education Department held that the activities attributed to Hussain warranted a major penalty and ordered his immediate dismissal from government service.
In a strong action, the government invoked Article 311(2)(b), read with Rule 30(viii) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956, stating that a regular departmental inquiry was not reasonably practicable in the circumstances of the case.
The order goes a step further, placing the matter in the category of “rarest of the rare cases”, as recorded by the competent authority, and dispensing with the normal departmental inquiry before imposing the major penalty.
The dismissal also carries a significant service bar, with the government order stating that Hussain shall ordinarily be disqualified from future government employment.
The action was formalised through Government Order No. 3880-JK(Edu) of 2026, issued by the School Education Department on September 21 and signed by Commissioner/Secretary to the Government, School Education Department, Ram Niwas Sharma.
The criminal allegations remain subject to proceedings in the competent court; the government action cited in the order is a service-disciplinary measure based on the material and circumstances placed before the competent authority.
