SRINAGAR, SEPT 29: The All Minority Employees Association Kashmir (AMEAK) has sought coverage under the Old Pension Scheme (OPS)/Defined Pension Rules for eligible PM Package employees, arguing that the posts against which they were recruited had been sanctioned, created and notified before January 1, 2010, when the National Pension System (NPS) came into force in Jammu and Kashmir.
AMEAK President Sanjay Koul and General Secretary Rohit Raina submitted a detailed representation to the Lieutenant Governor, seeking intervention and a rule-based examination of the pension claims in light of Government Order No. 305-F of 2026 dated September 28, 2026, and relevant Government of India instructions.
The association has cited Cabinet Decision No. 130/11/2009 dated October 1, 2009, and Government Orders Rev/MR/141 of 2009 dated October 26, 2009 and Rev/MR/147 of 2009 dated October 28, 2009, maintaining that the PM Package posts were sanctioned and formally created before the NPS cut-off.
According to AMEAK, the 2009 orders provided for the PM Package, including 6,000 government jobs, and creation of supernumerary posts in departments including Education, Social Welfare, Relief, Engineering, Health, Tourism, Finance and Revenue.
The association has also referred to the Department of Pension & Pensioners’ Welfare Office Memorandum dated March 3, 2023, arguing that the pension regime should be examined with reference to posts or vacancies advertised/notified before the NPS notification date.
AMEAK has highlighted that while the posts were created and notified in October 2009, subsequent recruitment processes took place after January 1, 2010, including JKSSB Advertisement Notice No. 01 of 2010 for 1,590 posts and a later recruitment process for another 1,443 posts.
The association argues that the subsequent recruitment timeline was beyond the control of candidates and that the date of post creation and notification should be examined separately from the date of recruitment advertisement.
AMEAK has sought verification of the pre-2010 status of PM Package posts, examination of OPS eligibility under applicable rules, and modification of Annexure-A of Government Order No. 305-F of 2026 to include referral/requisition details for each post.
It has further sought, subject to the applicable rules and legal position, a one-time option for OPS/Defined Pension Rules and GPF coverage for eligible PM Package employees.
The representation has also been forwarded to the Finance Department, General Administration Department, Department of Disaster Management, Relief, Rehabilitation & Reconstruction, and Commissioner Relief & Rehabilitation for necessary action.
